1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of BrainyBuddy (“the Service”), operated by Sergio Verdugo from Spain. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Service Description

BrainyBuddy is an AI-powered academic platform for students and professors. Features include smart study scheduling, AI-powered chat assistance, flashcard generation with spaced repetition, practice exam creation, study note generation, presentation building, AI grading, and two-way calendar synchronization with Google Calendar and ICS feeds.

3. Account Registration

You must provide accurate and complete information during registration.
You are responsible for maintaining the security of your account credentials.
Each person may only maintain one account.
You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

When using BrainyBuddy, you agree not to:

Abuse, manipulate, or exploit AI features for purposes unrelated to academic work.
Upload illegal, harmful, or copyrighted content that you do not have the right to use.
Attempt to reverse-engineer, decompile, or extract source code from the Service.
Share your account credentials with others or allow unauthorized access.
Use the Service to facilitate academic dishonesty or plagiarism.

5. User Content

You retain full ownership of all content you upload to BrainyBuddy, including documents, images, and study materials. By uploading content, you grant us a limited, non-exclusive license to process, store, and display it solely for the purpose of delivering the Service to you. We do not sell, share, or monetize your content for any purpose beyond providing the Service.

6. AI-Generated Content

BrainyBuddy uses artificial intelligence to generate content such as flashcards, practice exams, study notes, grading feedback, and presentations. This content is provided “as is” without warranties of accuracy or completeness. AI-generated content is intended as a study aid and should not be treated as authoritative. You are responsible for reviewing all AI-generated content before relying on it for academic purposes.

7. Subscription and Payment

A free tier is available with limited features and usage.
Paid subscription tiers are billed on a monthly basis, with prices denominated in EUR.
We reserve the right to change subscription prices with at least 30 days' advance notice.
Cancellation takes effect at the end of the current billing period.

8. Intellectual Property

The BrainyBuddy name, logo, brand identity, application code, and design are the property of Sergio Verdugo. Open-source components used within the Service are subject to their respective licenses. Nothing in these Terms grants you any right to use our trademarks, brand assets, or proprietary technology beyond normal use of the Service.

9. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, we are not liable for:

Inaccuracies in AI-generated content, including exam questions, grading feedback, or study materials.
Data loss beyond reasonable technical measures taken to prevent it.
Service interruptions, downtime, or temporary unavailability.
Academic outcomes or grades resulting from use of the Service.

10. Account Termination

You may delete your account at any time through the settings page or by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms, with notice where reasonably possible. Upon termination, your data will be handled in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of Spain. European Union consumer protection regulations apply where applicable. Any disputes arising from these Terms or your use of the Service shall be subject to the jurisdiction of the courts of Spain.

12. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
